Out-of-store iPhone 3g

I have an urgent iPhone question and I can't imagine who else would honestly answer it for me:

I am not eligible for the iPhone upgrade as I've been using an unlocked iPhone for the last year. Someone has offered to sell me an 8g iPhone 3G for $500, which would be about the cost of a subsidized phone canceled ($199+$175+$70+$30). If they charged the phone to their credit card, I unlock the phone at home, am I going to get hit with an unactivated phone subsidy fee from AT&T somehow or would the person on who's credit card it is on?
